Walloon legislative framework

In Wallonia, the competent administrative authority is the Service Public de Wallonie – Département du Sol et des Déchets.

The texts relating to environmental legislation are included in the Décret Déchets and the Arrêté tri.

Wallonie Spw

Décret déchets

The Décret relatif aux déchets, à la circularité des matières et à la propreté publique defines the framework for waste management in Wallonia.

Objectives:

  • To prevent or reduce the production of waste and the harmfulness thereof
  • To promote the recovery of waste, in particular through recycling, reuse, recovery and use as an energy source
  • To organise the disposal of waste
  • To limit, monitor and control the transfer of waste
  • To ensure the recovery of the sites.

The Arrêté tri

The Arrêté tri (2015) defines the sorting obligations imposed on companies.

Companies established in Wallonia must separate 15 different waste fractions at source. For some types of waste, the obligation only applies if the quantities produced exceed certain thresholds.

Companies must conclude a contract with a collector registered with the Département du Sol et des Déchets.

What are my obligations?

Myrc Plastique

The revision of the arrêté tri is currently ongoing.

The following adjustments are expected:

  • Abolition of sorting thresholds
  • New sorting obligations
    • Agricultural film
    • Bio-waste
